Hubba Baba Terms of Service and End-User License Agreement

1. Agreement to These Terms

These Terms of Service and End-User License Agreement (“Terms”) are a binding agreement between you and JMP, an independent sole trader (autónomo) established in Spain (VAT/NIF ES46989635Z) Capità Mirambell 22, 08320 el Masnou, Spain, doing business as Hubba Baba (“Hubba Baba,” “we,” “us,” or “our”), governing your use of the Hubba Baba mobile application, website, and related services (collectively, the “Services”).

By creating an account, downloading, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Our Privacy Policy, Consumer Health Data Privacy Policy, and Community Guidelines are incorporated into these Terms by reference.

PLEASE READ SECTION 19 CAREFULLY. IT CONTAINS A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

2. Eligibility

You must be at least 18 years old to use the Services. There are no exceptions. By using the Services, you represent and warrant that you:

  • Are 18 or older;
  • Have never been convicted of, or pled no contest to, a felony, a sex offense, or any crime involving violence, and are not required to register as a sex offender with any government entity;
  • Have not previously been removed from the Services or otherwise prohibited from using them;
  • Are not located in, or a resident of, a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not listed on any U.S. Government list of prohibited or restricted parties;
  • Will comply with these Terms and all applicable laws.

We do not conduct criminal background checks on users. See Section 9.

3. Your Account

You must provide accurate information when registering and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

You may hold only one account. Accounts are personal to you and may not be sold, transferred, or licensed to anyone else.

Account deletion. You may delete your account at any time within the app: tap the Profile button at the bottom right of the main screen, tap Delete Account, and confirm. Deleting the app from your device does not delete your account.

4. Account & Identity Verification

To maintain an authentic, trusted, and spam-free community, Hubba Baba offers optional verification features for your account:

  • Email Verification (Optional): Email verification is optional. If you choose to verify your email address, a secure verification link or code is sent to your email to validate and confirm ownership of your email address. Validating your email adds an extra layer of account security, makes password recovery easier, and helps confirm authentic membership.

  • Selfie Verification (Optional for Profile Badge):

    Selfie verification is also completely optional. If you choose to verify your profile to earn a verified checkmark badge and prevent fake accounts, you acknowledge that:

    • Verification uses automated processing (via Google LLC’s Gemini API) to compare your selfie to your profile photos;
    • Biometric data is collected only with your separate, prior express written consent, as described in the Biometric Information section of our Privacy Policy and our Consumer Health Data Privacy Policy;
    • Your verification selfie is uploaded over an encrypted connection and deleted immediately upon completion of verification;
    • No account is rejected by automated means alone — a member of our team reviews any failed verification before a final decision is made;
    • Verification confirms only that an account appears to belong to a real person matching their photos. It is not a background check, criminal screening, or guarantee of any user’s identity, character, intentions, or safety.

Both email verification and selfie verification are optional; you can skip either or both and still use the app. We may suspend or terminate accounts that we reasonably believe are fraudulent, impersonating others, or violating these Terms.

5. License Grant and Restrictions

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Hubba Baba application on supported devices that you own or control (including Apple-branded iOS devices as permitted by the Apple App Store Terms of Service, and Android devices as permitted by the Google Play Terms of Service), solely for your personal, non-commercial use. This license does not allow you to use the application on any device that you do not own or control, and you may not distribute or make the application available over a network where it could be used by multiple devices at once.

You may not:

  • Copy, modify, reverse engineer, decompile, or create derivative works from the Services, except as permitted by law;
  • Use bots, scrapers, crawlers, or automated means to access, collect data from, or interact with the Services;
  • Use the Services for any commercial purpose, including advertising, solicitation, recruiting, or promoting any product, service, or other platform, without our written permission;
  • Copy, store, or redistribute other users’ photos, messages, or profile information;
  • Circumvent security features, rate limits, verification, or bans (including creating a new account after removal);
  • Interfere with the operation of the Services or any other user’s use of them.

6. User Content

“User Content” means anything you submit through the Services — photos, profile text, messages, questions, and other material.

You own your User Content. By submitting it, you grant Hubba Baba a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting and display), and display your User Content solely for the purpose of operating, providing, and improving the Services. This license ends when you delete the User Content or your account, except for (a) content already shared with other users, (b) copies retained in backups until deleted in the ordinary course, and (c) content retained for safety, legal, or moderation purposes as described in our Privacy Policy.

You represent that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law.

You are solely responsible for your User Content and for your interactions with other users.

7. Prohibited Content and Conduct — Zero Tolerance

We have zero tolerance for objectionable content and abusive users. You may not post, send, or engage in:

  • Nudity, pornography, sexually explicit content, or sexually suggestive content involving minors of any kind;
  • Any content that sexualizes, depicts, or solicits minors. Child sexual abuse material is reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
  • Commercial sexual activity, prostitution, escort services, sex trafficking, or human trafficking of any kind;
  • Harassment, bullying, stalking, threats, intimidation, or hate speech targeting any person or group, including on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or age;
  • Violence, threats of violence, or content promoting self-harm, suicide, or eating disorders;
  • Scams, fraud, romance scams, phishing, requests for money, cryptocurrency or investment solicitations, or financial exploitation of any kind;
  • Impersonation of any person, including creating a profile of someone else without their consent;
  • Illegal drugs, weapons sales, or any other illegal goods or activity;
  • Spam, chain messages, or bulk unsolicited messaging;
  • Sharing another person’s private information (including photos, contact details, or location) without consent;
  • Any content that infringes intellectual property rights or violates any applicable law.

Enforcement. We may remove content, restrict features, suspend, or permanently terminate any account that violates these Terms, with or without notice, at our sole discretion.

8. Reporting, Blocking, and Moderation

Blocking. You can block any user in two taps from their profile or your chat with them. Blocking prevents further contact.

Reporting. You can report any user or piece of content from within the app. Reports go directly to our moderation team.

Our commitment. We review reports of objectionable content and abusive behavior and act on them — including removing content and ejecting users — within 24 hours of receiving a report. You may also report content or safety concerns directly to [email protected].

Filtering. We use a combination of automated filtering and human moderation to detect and remove objectionable content.

Consequences. Users who violate Section 7 may be permanently banned. We reserve the right to report illegal activity to law enforcement, and to cooperate with lawful requests in investigations of harm to any person.

9. Safety, Background Checks, and Your Interactions with Other Users

READ THIS SECTION CAREFULLY.

  • We do not conduct criminal background checks or identity verification against government databases. Selfie verification (Section 4) confirms only that an account appears to belong to a real person matching their photos.
  • We do not vouch for any user. We make no representations about the identity, background, character, conduct, intentions, marital status, or compatibility of any user.
  • You are solely responsible for your interactions with other users, online and in person. You assume all risk associated with meeting or communicating with anyone through the Services.
  • Use caution. Meet in public places, tell a friend where you’re going, arrange your own transportation, don’t share financial information, and never send money to someone you met on the Services — requests for money are the single most common sign of a romance scam.
  • If you feel unsafe, leave the situation and contact local law enforcement by calling 911.

Banned-user notifications. Where required by applicable law, if you have exchanged messages with a user who is subsequently banned from the Services for fraud, we will notify you and provide the information required by that law.

10. Matchmaker Mode

Matchmaker Mode allows a family member or friend (a “Matchmaker”) to create and manage a profile on behalf of another adult (the “Subject”) and to browse and connect with other users on the Subject’s behalf.

If you use Matchmaker Mode, you represent and warrant that:

  • The Subject is 18 or older;
  • You have the Subject’s actual, informed consent to create and manage a profile on their behalf, to provide their personal information to us, and to communicate with other users on their behalf;
  • All information you provide about the Subject is accurate;
  • The Subject has been informed of, and agrees to, these Terms and our Privacy Policy.

Prohibited. Creating a profile for any person without their consent is impersonation and is strictly prohibited under Section 7. We will remove such profiles and may permanently ban the responsible account.

Subject rights. Any person who is the subject of a Matchmaker Mode profile may contact [email protected] at any time to access, correct, or immediately delete that profile and the associated personal information.

Responsibility. The Matchmaker and the Subject are jointly responsible for all activity conducted through a Matchmaker Mode profile. Matchmakers may not use the Services to deceive, coerce, or arrange a relationship or marriage against the Subject’s wishes.

11. Date Spot Recommendations and Third-Party Content

The Services may recommend cafes, restaurants, and other venues for meetups. These recommendations are provided for convenience only. We do not own, operate, endorse, or guarantee any third-party venue, and we are not responsible for anything that occurs at or in connection with any venue, including its safety, quality, availability, pricing, or conduct of its staff. Some venues may be promoted or paid placements; where that is the case, we will disclose it.

The Services may contain links to third-party websites or services. We are not responsible for their content, policies, or practices.

12. Premium Subscriptions and Payments (Apple App Store & Google Play Store)

The Services are free to download and use. Optional premium features are available by subscription on both the Apple App Store (iOS) and the Google Play Store (Android), including Unlock Viewer, Unlimited Question Asks, and Unlimited Profile Views. Subscriptions on both platforms provide identical premium benefits, durations, and pricing tiers.

Subscription terms:

  • Price and duration: Premium Subscription is monthly at 29.99 (or local currency equivalent in your region’s app store). Current pricing is displayed in the app prior to purchase. Prices are subject to change with notice, effective at your next scheduled renewal.

  • Billing:

    • Apple App Store (iOS): Payment is charged to your Apple ID account upon purchase confirmation. Transactions are processed securely by Apple.
    • Google Play Store (Android): Payment is charged to your Google Play account upon purchase confirmation. Transactions are processed securely by Google.
    • Hubba Baba does not directly collect, receive, or store your payment card numbers.
  • Automatic renewal: Subscriptions renew automatically at the then-current price unless auto-renew is turned off or canceled at least 24 hours before the end of the current billing cycle. Your account (Apple ID or Google Play) will be charged for renewal within 24 hours prior to the conclusion of the current cycle.

  • Managing and canceling:

    You can manage your subscription and turn off auto-renewal at any time in your device’s store account settings:

    • iOS / Apple: Open iOS Settings → tap [your name] → Subscriptions → Hubba Baba → Cancel Subscription.
    • Android / Google Play: Open the Google Play Store app → tap Profile icon (top right) → Payments & subscriptions → Subscriptions → Hubba Baba → Cancel subscription.

    Deleting the Hubba Baba app from your device or deleting your profile does not automatically cancel your subscription with Apple or Google Play.

  • Free trials (if offered): Any unused portion of a free trial period is forfeited when you purchase a subscription. If you cancel before the trial concludes in your Apple or Google account, you will not be charged.

  • Refunds:

    All purchases are governed by the respective store terms:

    • Apple App Store purchases: Refund requests are handled directly by Apple under the Apple Media Services Terms and Conditions. Contact Apple at reportaproblem.apple.com.
    • Google Play Store purchases: Refund requests are handled under Google Play refund policies. Visit support.google.com/googleplay or submit a refund request through your Google Play order history.
  • No refund on termination for cause: If we terminate your account for violating these Terms or our Community Guidelines, you are not entitled to a refund of any unused subscription period.

Premium features do not guarantee matches, responses, dates, or any particular outcome.

Virtual items. Any in-app credits or items are licensed, not sold, have no monetary value, cannot be exchanged for cash, and are forfeited on account termination.

13. Intellectual Property

The Services — including software, design, text, graphics, logos, and the Hubba Baba name and marks — are owned by us or our licensors and protected by intellectual property laws. Except for the limited license in Section 5, no rights are granted to you.

Feedback. If you send us suggestions or feedback, we may use them without restriction or compensation to you.

Copyright complaints (DMCA). If you believe content on the Services infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) to [email protected] with the subject line “DMCA Notice.” We terminate repeat infringers. Full details are in our [DMCA Policy].

14. Suspension and Termination

By you: Delete your account at any time (Section 3).

By us: We may suspend or terminate your account or access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us or other users, or engaged in fraudulent or illegal conduct — or for any other reason at our discretion, to the extent permitted by law.

Effect of termination: Your license ends immediately. Sections 6 (as to licenses granted before termination), 9, 13, 15, 16, 17, 18, 19, and 20 survive termination.

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free; that defects will be corrected; that you will find a match, a date, or a relationship; or that any user is who they claim to be. We are not responsible for the conduct of any user, online or offline.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

16. Limitation of Liability and Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUBBA BABA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING FROM OR RELATING TO THE SERVICES OR YOUR INTERACTIONS WITH ANY USER.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, willful misconduct, or personal injury caused by our negligence where such limitation is prohibited.

Indemnification. You agree to indemnify and hold harmless Hubba Baba from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Services, your violation of these Terms, your violation of any law or third-party right, or your interactions with any other user — including any claim brought by a person whose profile you created through Matchmaker Mode.

17. Apple App Store & Google Play Store Platform Terms

These Terms serve as the End-User License Agreement for the Hubba Baba application. You acknowledge and agree that:

  1. Parties: These Terms are concluded between you and Hubba Baba only, and not with Apple Inc. or Google LLC. Hubba Baba is solely responsible for the application and its content.
  2. Scope of license: The license granted in Section 5 is limited to a non-transferable license to use the application on Apple-branded products (governed by the Apple Media Services Terms) or Android-compatible devices (governed by Google Play Terms of Service) that you own or control.
  3. Maintenance and support: Hubba Baba, not Apple or Google, is solely responsible for providing maintenance and support for the application. Neither Apple nor Google has any obligation to furnish any maintenance or support services.
  4. Warranty: In the event of any failure of the application to conform to any applicable warranty, you may notify the respective store (Apple or Google), and they may refund the purchase price (if any) according to their policies. To the maximum extent permitted by applicable law, neither Apple nor Google will have any other warranty obligation whatsoever.
  5. Product claims: Hubba Baba, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the application or your possession and use of it, including product liability claims, regulatory compliance, and consumer protection laws.
  6. Intellectual property claims: In the event of any third-party claim that the application or your possession and use of it infringes that third party’s intellectual property rights, Hubba Baba, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
  7. Legal compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Contact: Questions, complaints, or claims regarding the application should be directed to [email protected].
  9. Third-party beneficiaries: Apple and Apple’s subsidiaries, and Google and Google’s subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, they will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as third-party beneficiaries.

18. Changes to the Services and These Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms. If we make material changes, we will provide notice through the app or by email before they take effect, and update the “Last Updated” date. Your continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services and delete your account.

19. Dispute Resolution, Arbitration, and Class Action Waiver

Informal resolution first. Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. Except as stated below, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by [ARBITRATION PROVIDER, e.g., the American Arbitration Association] under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in [VENUE], or by videoconference or telephone at your election, and may be conducted on the papers where permitted.

Exceptions. Either party may bring an individual claim in small claims court. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Services. Nothing in this section prevents you from bringing a claim relating to sexual assault, sexual harassment, or physical harm in court, and you retain the right to bring such claims in a court of competent jurisdiction. Nothing prevents you from reporting conduct to, or filing a complaint with, any government agency.

CLASS ACTION WAIVER. YOU AND HUBBA BABA AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable as to a particular claim, that claim will proceed in court and the remainder of this section will remain in effect.

Opt-out. You may opt out of this arbitration agreement by emailing [email protected] with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms, including your name and the email address on your account. Opting out does not affect any other part of these Terms.

Governing law. These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs the arbitration provisions. Residents of certain U.S. states may be entitled to the protections of their home state’s consumer laws regardless of this provision.

20. General

  • Entire agreement: These Terms, together with the documents incorporated by reference, are the entire agreement between you and Hubba Baba regarding the Services.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
  • No waiver: Our failure to enforce any provision is not a waiver of it.
  • Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • No agency: Nothing creates a partnership, employment, or agency relationship between you and Hubba Baba.
  • Notices: We may provide notice by in-app message, email to your account address, or posting on our website.
